Information pursuant to and for the purposes of art. 13, EU REG. 2016/679

JOYFLO SRL has developed an App for green enthusiasts (hereinafter also referred to as “APP”), usable on both mobile devices and on the WEB.

To this end, JOYFLO informs you that – with the activation of the aforementioned APPLICATION – the personal data collected will be processed according to the terms and methods reported below.

DATA CONTROLLER

The data controller of the collected data is JOYFLO SRL, with registered office in Paese (TV), via Pravato, 50.

The said owner decides autonomously on the purposes and methods of the processing, as well as on the security procedures to be applied to guarantee the confidentiality, integrity and availability of the data.

DATA PROCESSED, PURPOSE OF PROCESSING, LEGAL BASIS AND STORAGE

Activationand use of the Application (Account Registration)

  • First and last name*; email address*; telephone number; address; date of birth, city*; gender.
    Or: Social account (first and last name and email address).
    *Mandatory data
  • Consent expressed by filling in the form for registration.
  • Data retention for the entire duration of activation, unless consent is revoked with the request for deactivation.
    Please note that data registration will not be indefinite, since 24 months after the last interaction of the registered user with the APP, the latter will be contacted to confirm such registration, and in case of failure to confirm, his account will be automatically deactivated.

Use of the various functions of the APP (e.g. finding advice and information on the world of greenery, requesting advice and support from agronomists; receiving personalized advice; purchasing products, etc.)

  • Address where the garden/terrace is located (1); images/videos of the garden, terrace, plants (2).
  • (1) Consent given by entering this information. (2) Consent expressed by uploading such images. Explicit consent to share data with other users.
  • Data retention for the entire duration of activation/registration, unless consent is revoked with the request for deactivation.

Geolocation

  • The location of the registered user.
  • Consent.
  • Data retention for the duration of the activation of the geolocation tool.

Management of purchase of packaged systems such as subscriptions for services of: plant recognition; request for advice from industry experts; crop care; APP store management.

Subsequent management of invoicing of purchases made.

  • User account; address; images/videos; other information provided when requesting consultants/experts; products/services purchased; products and services offered in the store managed in APP.
  • Execution of the contract (art. 6, paragraph 1, letter b) of EU Regulation 679/2016).
  • The data will be retained for the entire duration of the contractual relationship and for a period of 10 years following the conclusion of the contract;

User Satisfaction Rating

  • Data collection on user experience and satisfaction, through participation in specific questionnaires in order to improve the APP’s functionality.
  • Consent.
  • Data retention for a period of 24 months, unless the consent previously expressed is revoked.

Newsletter e Marketing

  • Account; email address; data on services requested; data on products purchased.
  • Consent; Legitimate interest, only in cases where the interested parties have provided their contact details in the context of a previous business relationship with JOYFLO. The latter may therefore use their data to send communications on its own products and services, similar to those already purchased, even without having acquired specific consent for this, unless such use is refused (so-called “soft spam” – art. 130, paragraph 4, Legislative Decree 196/2003; art. 6, paragraph 1, letter f) of EU Reg. 2016/679). In this case, in fact, the legal basis that justifies the processing is the legitimate interest of the Data Controller (Recital (47) of EU Reg. 2016/679).
  • Data retention for Newsletter: for the entire duration of activation, in the terms indicated in the first point of this table, unless a request to unsubscribe occurs. Marketing: for 24 months.

Analysis of user behavior aimed at improving the APP content and not for marketing purposes.

  • Data on content viewed and user behavior: average page view time; pages visited; statistics on CTAs; average time spent on the APP.
  • Legitimate interest of the Data Controller. This is not profiling, so it does not require consent, since the user is not subjected to a decision based on automated processing, so that such processing will not produce legal effects on the user or affect him or her in any way.
  • Data retention for 24 months.

Sharing/transferring data for indirect marketing purposes to third parties operating in the green sector.

  • User data.
  • Consent.
  • The data will be retained until the consent to such sharing/transfer is revoked.

TREATMENT METHODS

Personal data will be processed mainly electronically and digitally.
The processing operations will be carried out in such a way as to guarantee the logical and physical security and confidentiality of your personal data.
The data provided will be retained for the time strictly necessary to achieve the purposes for which they were collected.

MANDATORY OR OPTIONAL NATURE OF DATA PROVISION

Providing JOYFLO is only necessary for personal data used to activate and use the application. For other purposes, providing data is optional.

SCOPE OF COMMUNICATION AND DISSEMINATION OF DATA

Personal data will be shared with third parties operating in the Green sector (e.g. the agronomist consultant). In some cases, these will process data in the name and on behalf of Joyflo, as data controllers of the latter (art. 28 Reg. UE 679/2016).

The data, with prior consent, may be shared/transferred to third parties operating in the Green sector for indirect marketing purposes.

The data will also be communicated to the cloud system provider, currently AWS.

The data may also be communicated to our employees and/or collaborators, within the scope of their respective duties, as well as to professionals involved in the development and management of the APPLICATION.

SECURITY MEASURES

JOYFLO has adopted adequate security measures in order to minimize the risks of destruction or loss – even accidental – of data, unauthorized access or processing not permitted or not compliant with the indicated collection purposes.

DATA TRANSFER ABROAD

JOYFLO will not transfer data to third countries (non-EU countries) and/or to international organizations.

TOOLS USED BY JOYFLO (COOKIES)

General information about cookies

A cookie is a small amount of data sent to your browser from a website or an APP and which is then stored on your hard drive or mobile devices. The cookie is then reread and recognized by the web APP that sent it each time you make a subsequent connection.

TECHNICAL COOKIES

This type of cookie is strictly necessary for the correct functioning of some sections of the Site or APP. They are of two categories: persistent and session:

• persistent: once the browser is closed they are not destroyed but remain until a preset expiry date
• sessions: they are destroyed every time the browser is closed

These cookies are necessary to correctly display the Site or APP and in relation to the technical services offered, they will therefore always be used and sent, unless the user changes the settings in their browser (thus affecting the display of the pages of the Site or APP).

ANALYTICAL COOKIES

Cookies in this category are used to collect information on the use of the Site or APP.

Analytical cookies are sent from the Site/APP itself or from third-party domains.

THIRD PARTY SERVICE ANALYSIS COOKIES

These cookies are used to collect information on the use of the Site/APP by users in anonymous form such as: pages visited, time spent, origins of the traffic of origin, geographic origin, age, gender and interests for the purposes of marketing campaigns. These cookies are sent from third-party domains external to the site/APP.

Normally, most browsers are initially set to automatically accept cookies. You can change these settings to block cookies or to warn you when cookies are sent to your device: to change these settings you can refer to the instruction manual or the help screen of your browser.

COOKIES TO INTEGRATE THIRD PARTY SOFTWARE PRODUCTS AND FUNCTIONS

This type of cookie integrates features developed by third parties within the pages of the Site/APP such as, for example, icons and preferences expressed in social networks for the purpose of sharing the contents of the Site/APP or for the use of third-party software services. These cookies are sent from third-party domains and partner sites that offer their features between the pages of the site/APP.

PROFILING COOKIES

These are cookies necessary to create user profiles in order to send advertising messages in line with the preferences expressed by the user within the pages of the Site/APP.

The APP uses:

  • Necessary cookies
    Necessary cookies are essential for the basic functions of the website and the website will not function as intended without them. These cookies do not store personally identifiable information. These cookies are always active and will therefore always be used and sent unless the user changes the settings in their browser (thus affecting the display of the APP pages).

cookieyes-consent: is used to remember users’ consent preferences so that they are respected on subsequent visits to this site. It does not collect or store any personal information about site visitors. Duration: 1 year.

  • Functional cookies
    Functional cookies help to perform certain functionalities such as sharing website content on social media platforms, collecting feedback and other third-party functionalities.

pll_language: is used by Polylang to remember the language selected by the user when they return to the site and to obtain language information when it is not otherwise available. Duration: 1 year.

  • Other Third-Party Cookies

Our website uses embedded YouTube videos. We have configured the YouTube videos using the youtube-nocookie.com link, a mode that prevents YouTube from collecting cookies on users’ devices unless they directly interact with the video (for example, by playing it). In this way, we reduce the impact on user privacy by preventing data collection without their explicit consent.
However, even in “no cookie” mode, YouTube may still collect some technical information, such as the IP address and other browsing-related data, when a user views or interacts with the embedded videos.

Our website uses Google Analytics. This is a web analytics service provided by Google Inc. that uses cookies to enable statistical analysis in aggregate form regarding the use of the visited website. JOYFLO has activated the IP address anonymization feature. Furthermore, Google cannot combine the information collected with other data it already has.

How can I disable cookies?

Most browsers are configured to accept, control or possibly disable cookies through the settings.

The user can decide whether or not to accept cookies using the settings of their browser. The total or partial disabling of technical cookies may compromise the use of the APP’s functions. You can change these settings to block cookies or to warn you that cookies are being sent to your device.

RIGHTS OF INTERESTED PARTIES PURSUANT TO ARTICLES 7, 15, 16, 17 18, 20, 21 AND 22 OF EU REGULATION 2016/679

We inform you that in your capacity as interested party, you have, in addition to the right to lodge a complaint with a supervisory authority, the rights listed below, which you can assert by making a specific request to the Data Controller.

Art. 15 – Right of access

The interested party has the right to obtain from the data controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and information regarding the processing.

Art. 16 – Right of rectification

The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Art. 17 – Right to erasure (right to be forgotten)

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay.

Art. 18 – Right to limit processing

The interested party has the right to obtain from the data controller the limitation of processing when one of the following hypotheses occurs:

a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;

b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;

c) although the data controller no longer needs them for the purposes of the processing, the personal data are required by the data subject for the establishment, exercise or defence of legal claims;

d) the data subject has objected to processing pursuant to Article 21, paragraph 1, pending verification whether the legitimate grounds of the controller override those of the data subject.

Art. 20 – Right to data portability

The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

In exercising his or her right to data portability pursuant to paragraph 1, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

Art. 21 – Right to object

The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to processing of personal data concerning him or her which is based on Article 6, paragraph 1, letters e) or f), including profiling based on those provisions.

Art. 22 – Right not to be subjected to automated decision-making, including profiling

The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

Art. 7 – Revocation of consent to processing

The interested party has the right to withdraw consent to the processing of personal data.

At the end of this operation, personal data will be removed from the archives as soon as possible.
